Privacy Policy

Effective Date: 20 October 2026  |  Last Updated: 20 October 2026

1. Introduction

This Privacy Policy explains how OTHS Consultants LTD (“we,” “our,” or “us”), trading as OTHS, On Time Honest Solutions, OTHS Consultants, and OTHS Consulting, collects, uses, stores, and protects your personal data when you use our Website www.oths.ie or engage our services. We comply with the General Data Protection Regulation (GDPR) and the Data Protection Acts 1988–2018 (Ireland).

2. Information We Collect

  • Contact Information: name, email, phone, company details.
  • Service Information: data required to provide payroll, consulting, advisory, or company formation services.
  • Company Formation Information: if you apply to form a company, the details you enter about the company and its directors, secretary and shareholders, including full names, dates of birth, nationality, residential addresses, PPS numbers (where applicable), shareholdings, and whether you are resident in Ireland.
  • Identity Documents: copies of photo ID and proof of address that you upload for each director and secretary, which we are required by law to verify.
  • Payment Information: the invoice we issue you and whether it has been paid. We do not collect or store your card details; card payments are handled securely by our accounting platform (Xero) and its payment provider (Stripe).
  • Technical Data: IP address, browser/device info, cookies, and usage data.
  • Marketing Preferences: newsletter subscriptions, event sign-ups.

3. How We Use Your Data

  • Provide and manage our professional services, including forming and registering companies on your behalf with the Companies Registration Office (CRO) and Revenue.
  • Verify the identity of directors and carry out anti-money laundering checks.
  • Communicate regarding enquiries, proposals, and engagements.
  • Comply with legal and regulatory obligations.
  • Improve our Website and services.
  • Send newsletters/updates or marketing communications (with your consent; you may withdraw at any time).

4. Lawful Basis for Processing

  • Contract – delivering services you engage us for.
  • Legal obligation – meeting Irish/EU requirements (e.g., tax/regulatory), including customer due diligence under the Criminal Justice (Money Laundering and Terrorist Financing) Act 2010 (as amended) and our filing obligations to the CRO.
  • Legitimate interests – operating, securing, and improving our services.
  • Consent – where you opt in to marketing communications.

5. Data Sharing

We do not sell your personal data. We may share data with trusted service providers (e.g., IT, email, cloud, and payroll platforms such as Xero) and with regulators/authorities or legal advisors where required by law. For company formations, we share the information needed to register your company with the CRO and, where relevant, Revenue. Invoices are issued through Xero, with card payments processed by Stripe, and we use cloud hosting, database and email providers to run our systems. Third parties are contractually required to respect your privacy and comply with GDPR.

6. Data Retention

We retain personal data only as long as necessary to deliver services, maintain records, meet legal/tax/regulatory obligations, and for marketing until you opt out. Irish anti-money laundering law requires us to keep identity verification records for at least five years after our business relationship with you ends. If you start a company formation application that does not proceed, we do not keep your uploaded identity documents for longer than necessary.

7. Data Security

We apply appropriate technical and organisational measures to protect your personal data against loss, misuse, or unauthorised access. Identity documents you upload are encrypted before they are stored, and access is restricted to authorised staff. No system is entirely secure; we cannot guarantee absolute protection.

8. Cookies

We use cookies to improve user experience and analyse performance. See our Cookies Policy for details and choices.

9. Your Rights

  • Access, rectify, or erase your personal data.
  • Restrict or object to processing.
  • Data portability.
  • Withdraw consent at any time (for consent-based processing).

To exercise these rights, contact our Data Protection Officer.

10. International Transfers

We primarily store and process data in Ireland, the EEA and the UK. Our company formation application runs in Ireland and its database is hosted in the UK, which is covered by an EU adequacy decision. Some of our service providers (for example accounting software or email delivery) may process data outside the EEA. Where this happens, we rely on an EU adequacy decision or implement appropriate safeguards (e.g., the EU–US Data Privacy Framework or EU Standard Contractual Clauses).
